A landlord who evicted an apartment owner who illegally rented out his home via Airbnb did the right thing, according to the Svea Court of Appeal, writes Hem & Hyra.

The tenant had been subletting his apartment in central Gothenburg for several years at regular intervals, without asking the landlord for permission. Even after the landlord discovered it and asked for the subletting to cease, the activity continued.

Earlier this year, the landlord was given the right by the rental board to terminate the apartment contract. The tenant then appealed to the Svea Court of Appeal, which agrees with the rental board's assessment and states that the subletting has been so extensive that it is comparable to hotel operations. The decision in the Svea Court of Appeal cannot be appealed.
