Norwegian accuses Boeing of fraud and breach of contract

Norwegian low-cost airline Norwegian has sued Boeing in a court in Illinois, accusing the aircraft manufacturer of fraud, breach of contract and lies, writes E24 with reference to legal documents.

Norwegian announced plans to sue Boeing over the company's withdrawal of orders for a total of 97 aircraft, worth 122.34 billion Norwegian kroner. The lawsuit was filed in Illinois Northern District Court on Monday by Norwegian ASA and its subsidiary Arctic Aviation Assets DAC.

The lawsuit accuses Boeing of gross negligence, fraud and breach of contract related to the purchase of 737 MAX and 787 Dreamliner aircraft.

 ”"Instead of delivering what was promised, Boeing has demonstrably misled and omitted information, demonstrated gross negligence and defective production, and manufactured aircraft with substantially lacking value or utility, which in the case of the MAX aircraft had tragic and fatal consequences," the lawsuit states, according to E24.

Norwegian's lawyers claim that Boeing's description of the MAX aircraft was "full of lies" without Norwegian understanding this.

Norwegian is demanding the return of advances already paid, as well as compensation for the problems it has had with the 737 MAX, which has been grounded since March last year, and for the battery and engine problems with the 787 Dreamliner. The court is tasked with determining the total amount of compensation.

Boeing writes in an email to E24 that it is working to "find the way forward" together with Norwegian and other players who are going through a challenging time.
